These terms apply when a consumer buys Gecko Panes, accessories, surveys or installation services from Gecko Glazing Ltd. They explain who is responsible for measurements and installation, when an order can be cancelled, and what happens if something goes wrong.
Please read these terms before placing an order and keep a copy with your order confirmation. Nothing in these terms limits your statutory rights as a consumer.
- Who we are and how to contact us
- We are Gecko Glazing Ltd., a company registered in Scotland under company number SC524562.
Our registered office is 4 Sauchiebank, Edinburgh, Scotland, EH11 2NN. - You can contact us at info@geckoglazing.co.uk or on 0131 305 0925. References in these terms to “Gecko”, “we”, “us” or “our” mean Gecko Glazing Ltd. References to “you” or “your” mean the consumer placing the order.
- These terms are intended for customers acting wholly or mainly outside their trade, business, craft or profession. If you are purchasing for business purposes, please ask us for our business terms.
- An ‘Independent Contractor’ means a surveyor, installer or other service provider who contracts with and is paid by you directly rather than supplying the service under your contract with Gecko.
- We are Gecko Glazing Ltd., a company registered in Scotland under company number SC524562.
- What these terms cover
- These terms apply to goods and services that your quotation or order confirmation says are supplied by Gecko. Goods may include made-to measure secondary-glazing panes (“Gecko Panes”) and standard accessories. Services may include a survey or installation where Gecko is named as the supplier.
- Your contract consists of these terms, your accepted quotation or online order, our order confirmation, and any specification or drawing expressly incorporated into the order. If there is a conflict, a specific written term in the order confirmation or accepted quotation takes priority over these general terms.
- Our Privacy Policy explains how we use personal information. Our separate Guarantee explains any additional commercial guarantee. A commercial guarantee is additional to, and does not replace, your statutory rights.
- Quotations, orders and the contract
- A quotation is valid for the period stated on it. If no period is stated, it is valid for 14 days. We may withdraw a quotation before you accept it.
- An online listing or quotation is an invitation to place an order, not an offer that we are obliged to accept. Your order is an offer to buy the goods or services described in it.
- A binding contract is formed when we send you an order confirmation, accept your quotation in writing, or begin work with your agreement—whichever happens first.
- Please check the order confirmation carefully, including the number, dimensions, shape, material, colour and delivery address. Tell us promptly if anything is wrong. A requested change is effective only when we confirm it in writing, and may change the price and timetable.
- We may refuse or cancel an order before manufacture if we cannot accept it, for example because the product is unavailable, information is incomplete, a pricing error is obvious, the specification is unsafe or impracticable, or we cannot deliver to your area. If we cancel after taking payment, we will refund sums paid for anything we will not supply.
- Product descriptions, appearance and suitability
- We will supply goods that match their description and any specification agreed with you. Images, samples and screen colours are illustrative; minor colour and appearance differences may arise from screens, lighting, material batches and manufacturing tolerances.
- Gecko Panes are designed as removable secondary glazing fitted to suitable existing windows. Suitability depends on the window’s design, condition, available fixing surface, access and other site specific factors.
- Published thermal, acoustic and condensation information may include controlled test results or typical outcomes. Results in a particular property vary with the existing window, fit, gaps, ventilation, humidity, exposure and building fabric. We do not guarantee a particular temperature, energy saving, sound reduction, EPC outcome or elimination of condensation unless we expressly agree that result in writing for your property.
- Moisture may sometimes form between a Gecko Pane and the existing window. This does not by itself establish a product fault; the cause may include moisture entering through the existing window, indoor humidity, ventilation or fit. We will assess any reported issue fairly, and this clause does not affect your rights if the goods or services do not conform to the contract.
- You are responsible for checking whether planning permission, listed building consent, landlord or freeholder consent, or another approval is required, unless our quotation expressly says we will do this for you.
- Measurements and information
- If you or someone you appoint supplies measurements, templates, photographs or specifications, you are responsible for their accuracy and completeness. We are not responsible for a mismatch caused by inaccu ate customer supplied information, provided we have manufactured the goods to the agreed specification.
- If the contract states that Gecko will survey or measure the windows, Gecko is responsible for measurements taken by us or by a surveyor acting as our subcontractor. We may need you to approve a final schedule or specification, but that approval does not transfer responsibility to you for errors in measurements we took.
- If an Independent Contractor surveys or measures under a separate contract with you, that Independent Contractor is responsible for their survey, measurements and services. We remain responsible for the goods and any services supplied by Gecko.
- Tell us before ordering about unusual shapes, damaged or distorted windows, obstructions, shutters, blinds, alarms, restricted access or any other feature that may affect manufacture, delivery or installation.
- Prices and payment
- The price, VAT, delivery charge and any survey or service charge will be shown in your quotation, checkout or order confirmation. If a delivery address attracts a carrier surcharge that could not reasonably be calculated in advance, we will tell you and obtain your agreement before charging it.
- Any deposit and balance-payment stages will be stated in the quotation or order confirmation. We may pause manufacture, delivery or Gecko supplied services while an amount is overdue, after giving you reasonable notice.
- Where installation is provided under a separate contract with an Independent Contractor, the installation fee is not payable to Gecko unless the quotation or order confirmation expressly says otherwise. The Independent Contractor should tell you their price and payment terms separately.
- Discounts and promotions are subject to the terms stated with the offer, including eligibility, minimum spend, property limits and expiry date. Unless stated otherwise, discounts cannot be combined. This does not affect your rights in relation to sale items.
- You own the goods once we have received payment in full. Risk of loss or damage passes to you when the goods are delivered into your physical possession, or into the possession of a person you identify to receive them.
- Manufacture, delivery and collection
- Any manufacturing or delivery date is an estimate unless we expressly agree in writing that it is a binding deadline. We will deliver within the period stated in the order confirmation or otherwise agreed with you. If no period is agreed, we will deliver without undue delay and within 30 days after the contract is made.
- We may deliver an order in instalments where reasonably necessary and without charging you additional delivery costs.
- You must provide a complete and accurate delivery address and reasonable information needed for delivery. If delivery or collection fails because you do not take reasonable steps to receive the goods, we may charge reasonable storage and redelivery costs after telling you what those costs are.
- Please inspect packages as soon as reasonably practicable and contact us promptly about visible transit damage, preferably with photographs. Prompt notice helps us claim against the carrier, but failing to report immediately does not remove your statutory rights.
- If delivery is delayed by an event outside our reasonable control, we will contact you and take reasonable steps to minimise the delay. Your legal rights relating to late delivery, including any right to set a reasonable further deadline or end the contract, are unaffected.
- Installation arrangements
- Your quotation or order confirmation will say whether installation is: (a) supplied by Gecko as part of your contract with us; (b) supplied under a separate contract between you and an Independent Contractor; or (c) carried out by you or someone you appoint.
- Where Gecko supplies installation, we will perform it with reasonable care and skill and within a reasonable time, or within any agreed period. We may use suitably qualified subcontractors, but remain responsible to you for the service supplied under our contract.
- Where you contract directly with an Independent Contractor, that Independent Contractor is responsible for their service, attendance, workmanship, charges and any damage they cause. Introducing or providing their contact details does not make Gecko a party to that separate contract. This does not exclude responsibility for any act or omission for which Gecko is legally responsible.
- For DIY installation, follow the instructions and use the product only as intended. We are not responsible for damage caused by installation that does not follow the instructions, misuse, alteration or unsuitable third-party work. This does not affect your rights where the product or our instructions are faulty.
- Access, window condition and additional work
- If a survey or installation is arranged, you must provide safe and reasonable access at the agreed time, clear the work area, identify known hazards, and tell us about parking or access restrictions. Children and pets should be kept away from the work area.
- Unless expressly included in the quotation, the service does not include repairing, redecorating, draught-proofing or altering existing windows; moving furniture; removing or refitting blinds, shutters or alarms; scaffolding; electrical work; asbestos work; or making good pre-existing damage.
- Existing windows may have concealed defects, decay, distortion, loose paint, failing putty, unsafe glass or previous repairs that are not apparent before work starts. If unexpected work is reasonably required, work will pause where appropriate and no additional chargeable work will proceed without your agreement.
- If an appointment cannot proceed because safe access was not provided or relevant information was withheld, the supplier of the visit may charge a reasonable amount reflecting the actual loss caused, provided the possible charge and its basis were made clear before the appointment.
- Your cancellation rights
- You may withdraw an order before we accept it.
- Made-to-measure Gecko Panes are manufactured to your dimensions or other personal specification. The statutory 14-day change-of-mind cancellation right for distance contracts does not apply to goods made to the consumer’s specifications or clearly personalised. This exception does not affect your rights if the goods are faulty, misdescribed or otherwise do not conform to the contract.
- For standard, non-personalised goods bought online, by telephone or otherwise at a distance, you may cancel without giving a reason within 14 days after you—or a person you nominate other than the carrier—takes physical possession of the goods. If one order is delivered in separate lots, the period runs from receipt of the last lot.
- To cancel, send a clear statement to info@geckoglazing.co.uk or Gecko Glazing Ltd., 4 Sauchiebank, Edinburgh, Scotland, EH11 2NN. You may use the model form below, but do not have to.
- You must return cancelled standard goods within 14 days after telling us. You pay the direct return cost unless the goods are faulty or we agree otherwise. You are responsible for any reduction in value caused by handling beyond what is reasonably necessary to establish the goods’ nature, characteristics and functioning.
- We will refund sums due, including the cost of our least expensive standard delivery option, using the original payment method unless agreed otherwise. We may withhold the refund until we receive the goods or evidence that you sent them back. We will refund within the periods required by law.
- If you ask us to begin a cancellable service during the 14-day cancellation period, we will obtain your express request. If you then cancel after work has begun, you must pay a proportionate amount for the service supplied up to cancellation. You lose the right to cancel a service once it has been fully performed only if you expressly requested early performance and acknowledged that consequence.
- If you ask to cancel or change a bespoke order after the contract is formed, we will consider the request but do not have to accept it. If we agree, we may retain or charge a fair amount for work already carried out, materials committed and losses caused, and will explain the calculation.
- If goods are faulty, damaged or incorrect
- We have a legal duty to supply goods that are of satisfactory quality, fit for any particular purpose made known to us where you reasonably relied on us, match their description, and conform to the contract.
- If goods arrive damaged, are incorrect or appear faulty, contact us with your order details and a description of the problem. We may reasonably ask for photographs, measurements or access to inspect the goods. Do not dispose of or return made-to-measure goods until we have agreed a safe and reasonable method.
- Your remedies are those provided by the Consumer Rights Act 2015. Depending on the circumstances and timing, these may include the short term right to reject, repair or replacement, a price reduction, or a final right to reject. We will bear reasonable necessary costs where the law requires us to do so.
- We are not responsible for a problem caused by fair wear and tear, accidental damage after risk has passed, misuse, failure to follow instructions, customer-supplied incorrect measurements, unauthorised alteration, or unsuitable third-party installation—unless the underlying product or our instructions were themselves faulty.
- If a Gecko-supplied service is not performed properly
- We have a legal duty to perform services with reasonable care and skill. Information we give you about the service or trader may become binding where the law provides.
- If a Gecko-supplied service does not conform to the contract, you may be entitled to repeat performance or a price reduction under the Consumer Rights Act 2015. Nothing in these terms limits those rights.
- Our commercial guarantee
- Any Gecko commercial guarantee is governed by the separate Guarantee terms published on our website or supplied with your order. Please read its eligibility conditions, duration, remedies and exclusions.
- The commercial guarantee is free and additional to your statutory rights. Those rights may continue after the guarantee ends and are not affected by a guarantee claim being refused.
- Installing Gecko Panes yourself does not, by itself, invalidate an applicable commercial guarantee. The Guarantee terms explain when a problem caused by measurement, installation, misuse or alteration is excluded.
- Any First Pane Promise, trial-pane offer or other satisfaction promotion is governed by the eligibility, claim period and refund terms stated on our Guarantees page or in the written offer supplied to you.
- Our responsibility for loss or damage
- We do not exclude or limit liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or breach of your statutory consumer rights.
- We are responsible for loss or damage that is a foreseeable result of our breach of the contract or failure to use reasonable care and skill. Loss is foreseeable if it was obvious that it would happen or both parties knew it might happen when the contract was made.
- We supply consumer goods and services for domestic and private use. We are not responsible under these consumer terms for business losses such as loss of profit, revenue, business opportunity or business interruption. Customers buying wholly or mainly for business purposes must use our business terms.
- We are not responsible for delay or failure caused by events outside our reasonable control, but we will take reasonable steps to minimise the effect and this does not affect any statutory right to cancel or obtain a refund.
- Complaints
- If you have a complaint, contact us at info@geckoglazing.co.uk or write to Gecko Glazing Ltd., 4 Sauchiebank, Edinburgh, Scotland, EH11 2NN. Please include your order number, the issue and the outcome you are seeking.
- We will acknowledge and investigate complaints fairly and aim to provide a substantive response within five working days. Complex cases may take longer; if so, we will keep you informed.
- If we cannot resolve a dispute, we will provide any information about an appropriate certified alternative dispute resolution body that we are required to provide by applicable law. You may also seek advice from Citizens Advice or Advice Direct Scotland. You are not prevented from bringing court proceedings.
- Other important terms
- We may transfer our rights and obligations under the contract to another organisation, but only where this does not reduce your rights. You may transfer your rights with our written agreement, which we will not unreasonably withhold, or where the law permits.
- The contract is between you and us. No other person has a right to enforce it, except a person to whom rights are validly transferred.
- If a court finds part of these terms unlawful, the remaining parts continue in effect.
- If we delay enforcing the contract, we may still enforce it later.
- These terms and the contract are governed by Scots law. If you live in Scotland, the Scottish courts have jurisdiction. If you live elsewhere in the United Kingdom, you may bring proceedings in the courts of the part of the UK where you live, and may also have the benefit of mandatory local consumer protections.
